Surface Transportation Board Chairman Roger Nober today announced that the agency will hold a September 29, 2004 oral argument concerning the railroad rate-complaint case entitled Arizona Public Service Company & PacifiCorp v. The Burlington Northern and Santa Fe Railway Company, Docket No. 41185.

The STB will hold the oral argument at 10:00 a.m. on Wednesday, September 29, 2004, in Room 760, the agency's hearing room, on the 7th Floor of the agency's headquarters in the Mercury Building, 1925 K Street, N.W., Washington, D.C.

At issue are the maximum reasonable rates that "Burlington Northern" may charge for the transportation of coal from the Pittsburgh & Midway Coal Mining Company's McKinley Mine, northeast of Gallup, New Mexico, to an electric-generating plant near Joseph City, Arizona, owned by "Arizona Public Service" and PacifiCorp, the complainants in this case.
