Surface Transportation Board Dismisses "Grain Land" Rail Service, Car-Availability Complaint after Mediated Settlement


Surface Transportation Board (Board) Chairman Linda J. Morgan announced today that the Board has granted a joint railroad-shipper request that the Board dismiss a complaint in the case entitled Grain Land Coop v. Canadian Pacific Limited and Soo Line Railroad Company d/b/a CP Rail System, STB Docket No. 41687.



The Grain Land Coop had sought damages from the railroads for alleged general service and railcar service violations, as well as for alleged discrimination and unreasonable practices concerning car availability. The parties indicated to the Board that they have reached a mediated settlement, thus prompting them jointly to request dismissal, with prejudice, of all such claims currently pending before the Board.



The resolution of this matter is consistent with the Board's policy of encouraging private-sector dispute resolution whenever possible. The Board is committed to considering matters brought before it in a manner conducive to cooperative and creative private-sector dispute resolution, to the benefit of all involved parties.
