SURFACE TRANSPORTATION BOARD VICE CHAIRMAN FRANCIS MULVEY STATES INTENT TO CONTINUE TO SERVE


Surface Transportation Board Vice Chairman Francis P. Mulvey today stated that he has not identified a date for departure following the expiration of his term at the end of December. According to the Board’s governing statute, unless a successor is nominated to a Member’s seat by the President, confirmed by the Senate, and officially sworn in, the sitting Member may serve up to one year beyond the expiration of his or her term.


In announcing his intentions, Dr. Mulvey said,


“It has been an honor to serve as a Member of the Surface Transportation Board for the last 8 years. To ensure that the Board continues to have a full complement of Members and to reduce any gap that may occur between the end of my service and the appointment of a new Board Member, it has always been my intent to continue serving at the Board after the December 31 expiration of my term.”


Dr. Mulvey was originally nominated to the agency as a Member by President George W. Bush on November 17, 2003, and was confirmed by the Senate on May 21, 2004, for a term of office ending December 31, 2007. President Bush nominated him to a second term as a Member on November 30, 2007, and he was confirmed by the Senate on December 19, 2007, for a term ending December 31, 2012. Dr. Mulvey was designated the Board’s Acting Chairman on March 12, 2009, by President Barack Obama, and he served in that capacity until August 13, 2009. He currently serves as the Board's Vice Chairman (a position that annually rotates among Board Members other than the Chairman). He also oversees the Board’s review of the agency’s Uniform Rail Costing System.
